The case

We brought a claim on behalf of Good Law Project for judicial review of the award by East of England Broadband Network of the “Everything Net Zero” Framework Agreement to Place Group Limited. The claim was brought on the grounds that the contract award breached the Public Contract Regulations 2015.

The claim was significant owing to the £70 billion value of the ENZ Framework, which was awarded to a small private limited company for goods, services or works nominally linked to climate change across the entirety of the UK public sector.

Effectively, the design of the Framework Agreement created a mechanism whereby £70 billion of public contracts could be awarded without advertised, open, fair and effective competition. We achieved a successful outcome for our client and for wider reasons of public transparency and good administration – following the issuing of the claim, the defendant agreed to withdraw the Framework Agreement.
