The case

We have been working closely with Kings Counsel to develop a human rights challenge to hold the government to account in relation to its policies on reaching net zero.

The claimants will be young people who are directly impacted by climate change in the UK now and/or in the future and will argue that the government’s failure to create workable policies to achieve Net Zero has or will breach their ECHR Article 8, 3 and 14 rights.

The claim will likely be based around the principles set down in the forthcoming Agostinho ECtHR judgment, which is expected to founder due not having exhausted domestic avenues of challenge.

We are working with Good Law Project to identify claimants, and as it will be a multi-year challenge, with extensive use of expert evidence, we are in discussion with grant funders.

This will be the first of its kind claim in the UK.
